OF THE SPECIAL MEETING
OF THE GOVERNING BOARD
SCOTTSDALE SCHOOL DISTRICT NO. 48

March 5, 2004 A Special
Meeting of the Governing Board of the Scottsdale Unified School District,
#48, Maricopa County, was called to order at 2:10 PM, at the Scottsdale
School District Education Center Board Room, 3811 North 44th
Street, Phoenix, Arizona. Board Members
in attendance were Sandra Zapien-Ferrero, President; Karen Beckvar, Clerk;
Shari Avianantos; Joel S. Feldman; and Christine M. Schild. Associate Superintendent Don Jefferies was
also present. A quorum was present. Mrs. Schild
moved to convene in Executive Session for: A.
Discussion and consultation for legal advice from
attorneys for the public body, including advice concerning confidentiality
issues, privileges and other legal issues related to disciplinary/personnel
proceedings pursuant to A.R.S. §38-431.03(A)(3). B.
Discussion and consultation with attorneys for the
District to receive legal advice, determine the District’s position in
pending and contemplated litigation regarding Kim Youngblood and instruct the
District’s attorneys, pursuant to A.R.S. §38-431(A)(3) and (4). C.
Discussion and consultation with attorneys for the
District regarding confidential, attorney-client and work product privileged
information concerning the District's approach to handling prior serious
disciplinary matters and to receive legal advice on handling serious future
disciplinary matters, pursuant to ARS 38-431.01(A)(3). D.
Discussion and consultation with attorneys for the
District to receive legal advice and determine the District’s position in
contemplated litigation and instruct the District’s attorneys, pursuant to
A.R.S. §38-431(A)(3) and (4). E.
Discussion or consideration of possible discipline or
dismissal of employees pursuant to A.R.S. §38-431.03(A)(1), and legal advice
regarding the possible discipline or dismissal of the employees pursuant to
A.R.S. §38-431.03(A)(3). (The
employees have been notified in writing in accordance with this A.R.S.
§38-431.03(A)(1).) Ms. Beckvar
seconded the motion. The motion was
approved with a vote of 5 – 0. At 5:50 PM, the
Special Meeting was reconvened. In regard to
Item II. C., above, Mrs. Schild moved to direct the Superintendent to obtain
the remainder of the Booth file for the Board, except that information that
the Board’s attorney directed the Board not to review at this time. Mr. Feldman seconded the motion. Mr. Feldman
amended the motion that if any Board Member did review that information, the
Board Member would be required to sign a confidentiality agreement that the
information could not be released.
President Zapien-Ferrero asked Mrs. Schild if she would accept Mr.
Feldman’s amendment. Mrs. Schild
replied that she would. The motion, as
amended, was approved with a vote of 5 – 0. At 5:55 PM,
Mrs. Schild moved to adjourn the Special Meeting. Mrs. Feldman seconded the motion. The motion was
approved with a vote of 5 – 0. Dated this 5th
