MINUTES OF THE SPECIAL MEETING

OF THE GOVERNING BOARD

SCOTTSDALE SCHOOL DISTRICT NO. 48

 

February 12, 2002

 

A Special Meeting of the Governing Board of the Scottsdale Unified School District, #48, Maricopa County, was called to order at 6:10 PM, at the Scottsdale School District Education Center Board Room, 3811 North 44th Street, Phoenix, Arizona. 

 

Board Members in attendance were Barbara A. Newby, President; David R. Goldstaub, Clerk; Shari Avianantos; Thomas C. Carey; and Sandra Zapien-Ferrero.  Superintendent Barbara F. Erwin, and Associate Superintendent Don Jefferies were also present.  A quorum was present.

 

Mr. Carey moved to convene in Executive Session for:

 

A.       Discussion/consultation for legal advice with Board attorneys concerning voluntary resignation, pursuant to A.R.S. §38-431.03(A)(3).

 

B.       Discussion/consideration of the potential dismissal (adoption of statement of charges) of a District employee, and discussion or consultation with the District’s attorney/s pursuant to A.R.S. §38-431.03(A)(1) and (A)(3).  (The employee will be notified in writing in accordance with this statutory provision.)

 

C.      Discussion/consultation with the Board’s designated representatives in order to consider the Board’s position and instruct its representatives regarding the salaries, salary schedules or compensation paid in the form of fringe benefits of its employees and other terms and conditions of employment, so that those representatives can properly represent the Board in upcoming “Meet and Confer” sessions, pursuant to A.R.S. §38-431.03(A)(5).

 

Mrs. Zapien-Ferrero seconded the motion.

 

The motion was approved with a vote of 5 – 0.

 

At 7:12 PM, the Special Meeting was reconvened.

 

President Newby called for any legal action.  Mr. Goldstaub moved on Item II. B., (listed above), “after review and consideration of the statement of charges, which is based on the Administration’s investigation of the facts in this matter, I move to formally adopt the statement of charges relating to a teacher in this District.”  Mrs. Avianantos seconded the motion. 

 

The motion was approved with a vote of 4 – 1 (Mr. Carey voted nay).

 

At 7:15 PM, Mr. Goldstaub moved to adjourn the Special Meeting.  Mrs. Avianantos seconded the motion.

 

The motion was approved with a vote of 5 – 0.
