MINUTES OF THE SPECIAL MEETING

OF THE GOVERNING BOARD

SCOTTSDALE SCHOOL DISTRICT NO. 48

January 14, 2002

A Special Meeting of the Governing Board of the Scottsdale Unified School District, #48, Maricopa County, was called to order at 6:40 PM, at the Scottsdale School District Education Center Board Room, 3811 North 44^th Street, Phoenix, Arizona.

Board Members in attendance were Thomas C. Carey, President; David Goldstaub; and Barbara A. Newby. Shari Avianantos arrived at 6:45 PM. Sandra Zapien-Ferrero was absent. Superintendent Barbara F. Erwin was also present. A quorum was present.

Mrs. Newby moved to convene in Executive Session for:

A. Discussion/consultation with Board Attorneys to consider the Board’s position, and instruct its attorneys regarding that position on pending litigation involving Edward Biszantz, pursuant to A.R.S. §38-431.03(A)(4).

B. Discussion/consultation with Board Attorneys to consider the Board’s position, and instruct its attorneys regarding that position on potential litigation regarding the District’s expulsion policy, pursuant to A.R.S. §38-431.03(A)(3) and (4).

C. Discussion/consultation with Board Attorneys to consider the Board’s position, and instruct its attorneys regarding that position on potential litigation by the Scottsdale Educational Enrichment School, Inc. (SEES, Inc.), pursuant to A.R.S. §38-431.03(A)(3) and (4).

D. Discussion/consideration regarding Superintendent’s Evaluation, pursuant to A.R.S. §38.431.03(A)(1).

Mr. Goldstaub seconded the motion.

Mr. Carey asked for a separate vote on the four issues listed on the Agenda for the Executive Session.

On issues A, B, and D, the vote was 3 – 0, approving the motion to convene in Executive Session (Mrs. Avianantos had not yet arrived at the meeting).

On issue C, Mr. Carey recused himself from the vote; the vote was 2 – 0 to convene in Executive Session (Mrs. Avianantos had not yet arrived at the meeting).

At 7:40 PM, the Special Meeting reconvened. Mrs. Newby moved to recess the Executive Session until after the Regular Board Meeting. Mr. Goldstaub seconded the motion.

The motion was approved with a vote of 3 – 0 with 1 abstention from Mr. Carey (Mrs. Avianantos was present at this time).

At 8:20 PM, the Special Meeting resumed. Mr. Carey moved to reconvene in Executive Session. Mr. Goldstaub seconded the motion.

The motion was approved with a vote of 4 – 0.

At 8:50 PM, the Special Meeting was adjourned.
