A Special Meeting/Executive Session of the Governing Board of the Scottsdale Unified School District, #48, Maricopa County, was called to order at 4:45 PM, at the Scottsdale School District Education Center Board Room, 3811 North 44th Street, Phoenix, Arizona.

Board Members in attendance were Sandra Zapien-Ferrero, President; Michael Girand, Clerk; and Thomas C. Carey. Barbara A. Newby arrived at 4:55 PM. Kristy Ryan was absent. Associate Superintendent Betty Donaldson and Compliance Attorney Jack LaSota were also present. A quorum was present.

Mr. Carey moved to approve the Agenda. Mr. Girand seconded the motion.

The motion was approved with a vote of 3 — 0.

Mr. Carey moved to approve Action Agenda Item III. A. Approval of Personnel Action. Mr. Girand seconded the motion.

The motion was approved with a vote of 3 — 0.

Discussion ensued on Action Agenda Item III. B. Approval of Hearing Officer’s Recommendation for Student #134549. Mrs. Newby tabled this Item at the Board Meeting of November 14, 2000. Mr. Carey suggested waiting for Mrs. Newby to arrive at this meeting before voting on the Item.

At 4:55 PM, Mr. Carey moved to convene in Executive Session on Item IV. B. Discussion/consultation with Board Attorneys to consider the Board’s position and instruct its attorneys regarding that position on pending litigation involving Claimant Steven Feistner, pursuant to A.R.S.

§38-431.03(A)(4). Mrs. Zapien-Ferrero seconded the motion.

The motion was approved with a vote of 3 — 0.

At 4:55 PM, Mrs. Newby arrived at the meeting.

At 5:10 PM, the Special Meeting reconvened. Mr. Girand left the meeting; a quorum was present as Mrs. Newby was now in attendance.

Mr. Carey moved to approve Action Agenda Item III. B. Approval of Hearing Officer’s Recommendation for Student #134549. Mrs. Zapien-Ferrero seconded the motion with an amendment that Student #134549 be placed in an Alternative School for not less than one year, to comply with the District’s procedures on such issues. Mr. Carey accepted Mrs. Zapien-Ferrero’s amendment.

The amendment was approved with a vote of 3 — 0.

The original motion as amended was approved with a vote of 3 — 0.

At 5:25 PM, Mr. Carey moved to convene in Executive Session on Item IV. A. An appeal regarding the Hearing Officer’s Recommendation for Student #129039, pursuant to A.R.S. §15-843(B). Mrs. Newby seconded the motion.

The motion was approved with a vote of 3 — 0.

At 5:48 PM, The Special Meeting reconvened.

Mr. Carey moved to approve the Hearing Officer’s Recommendation for Student #129039. Mrs. Zapien-Ferrero seconded the motion.

The motion was approved with a vote of 3 — 0.

At 5:50 PM, Mr. Carey moved to adjourn the Special Meeting. Mrs. Newby seconded the motion.

The motion was approved with a vote of 3 — 0.
