A Special Meeting of the Governing Board of the Scottsdale Unified School District, #48, Maricopa County, was called to order at 6:05 PM, at the Scottsdale School District Education Center Board Room, 3811 North 44th Street, Phoenix, Arizona.

Board Members in attendance were Thomas C. Carey, President; Shari Avianantos; and David Goldstaub. Sandra Zapien-Ferrero, Clerk; arrived at 6:15 PM. Barbara A. Newby was absent.

Superintendent Barbara F. Erwin, and Compliance Attorney Jack LaSota were also present. A quorum was present.

Mr. Goldstaub moved to convene in Executive Session for:

  1. Discussion/consultation with Board Attorneys to consider the Board’s position, and instruct its attorneys regarding that position on potential litigation involving Carlos Lastufka, pursuant to A.R.S. §38-431.03(A)(4).
  2. Discussion/consultation with Board attorneys to consider the Board’s position, and to instruct those attorneys regarding that position, in settlement discussions conducted in order to avoid litigation regarding administrative contract rights and obligations, pursuant to A.R.S. §38-431.03(A)(4).
  3. Discussion/consultation with its designated representatives in order to consider its position and instruct its representatives regarding the salaries, salary schedules or compensation paid in the form of fringe benefits of its employees so that those representatives can properly represent the Board in upcoming "Meet and Confer" sessions, pursuant to A.R.S. §38-431.03(A)(5).
  4. Discussion/Consultation for legal advice concerning voluntary resignations and notices pursuant to A.R.S. §15-503(D) and (E), with Board attorneys, pursuant to A.R.S. §38-431.03(A)(3).
  5. Discussion/Consultation with Board attorneys to consider its position and instruct its attorneys regarding the Board’s position regarding an administrator’s contract that is the subject of negotiations and discussions in order to avoid litigation, pursuant to A.R.S. §38.431.03(A)(4).
  6. Discussion/Consideration of employment, dismissal or resignation of a District employee, pursuant to A.R.S. §38.431.03(A)(1). (The special notice requirement of this subsection will be complied with.)
  7. Discussion/Consideration of employment, assignment, or salary of a District employee, pursuant to A.R.S. §38.431.03(A)(1). (The special notice requirement of this subsection will be complied with.)

Mrs. Avianantos seconded the motion.

The motion was approved with a vote of 3 — 0.

At 7:10 PM, the Executive Session was recessed; the Special Meeting was reconvened and also recessed so that the Work/Study Meeting could convene.

At 9:30 PM, The Special Meeting reconvened. The Governing Board reconvened in Executive Session.

At 11:16 PM, the Special Meeting reconvened. Mr. Goldstaub moved that the Hearing Officer’s Recommendations for expulsions for Student #1140739 and #115682 be approved. Mrs. Zapien-Ferrero seconded the motion.

The motion was approved with a vote of 4 — 0.

Mr. Goldstaub moved to approve the Settlement Agreement between Carlos Lastufka and the District, effective today, April 10, 2001, which Agreement terminates his employment, effective today. Mrs. Avianantos seconded the motion.

The motion was approved 4 — 0.

The Special Meeting was recessed and the Executive Session was reconvened.

At 11:58 PM, the Special Meeting was reconvened.

Mr. Goldstaub moved to accept Mr. Tom Ziegler’s withdrawal of his revocation of his Separation Agreement and Release, executed on April 3, 2001, which makes Mr. Ziegler’s resignation effective March 20, 2001, and approve the modifications thereto. Mrs. Avianantos seconded the motion.

The motion was approved with a vote of 4 — 0.

At 11:59 PM, Mrs. Zapien-Ferrero moved to adjourn the Special Meeting. Mr. Goldstaub seconded the motion.

The motion to adjourn was approved with a vote of 4 — 0.
